Present

The process against Mr. Schucri Kafie in his capacity as Chairman of the Board of Directors of DIMESA and Mr. Juan Madrid in his capacity as General Manager of DIMESA, which was prosecuted in the Criminal Court of Tegucigalpa department of Francisco Morazán on June third two thousand and fifteen. In the initial hearing held on June sixteenth of this year, Mr. Schucri Kafie and Mr. Juan Madrid, were accused of being allegedly responsible without any factual or legal substantiation on the part of the judge in charge of the case.

Formal processing that is not firmly held due to the appeal filed before the Court of Criminal Appeal of Francisco Morazán, by the defense lawyers Tito Hernández Salgado and Jorge Leónidas Calderón.

In the same way, on July seventh of this year it was requested by the defense the marking of a hearing of revision of measures, which was overruled for now by the judge, causing a revision to note N. 3 dated June first two thousand and fifteen, according to brief # 978-SCJ-2015, issued by the presidency of the Supreme Court of Justice, establishing that the first holiday period of this year, will be from Monday June sixth to Sunday July nineteenth of this year, and at that period judicial work is suspended except for those hearings that had already been programmed, with the exception of tax requirements that enter the Court, therefore refusing the request, but once returning to a normal working period, the date and time to evacuate the request will be determined by the defense.

On July twenty-third of two thousand and fifteen, a hearing was held to review measures in the present process, in which the judge imposed on Mr Juan Madrid the measures laid down in article 173 paragraphs 6, 7, and 10 of the Code of Criminal Procedure, consisting in being submitted to sign on the fifteenth and thirtieth of each month to the Criminal Court of Tegucigalpa, the ban on leaving the country without prior authorization of the Court, and bail. In the same way, Mr. Schucri Kafie was submitted to sign on the fifteenth and thirtieth of each month to the Criminal Court of Tegucigalpa.
